WalkUpFire Terms of Use

These terms govern your use of the WalkUpFire app (“the App”), published by Almost to Code (“we”, “us”).
License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on any iOS or iPadOS device you own or control, subject to the Apple Media Services Terms and Conditions and these terms. You may not rent, lease, sublicense, reverse-engineer, or commercially exploit the App or its source material, including the bundled Ballpark Beats audio assets and the bundled pronunciation database.
Subscriptions and in-app purchases
WalkUpFire offers two paid options, processed entirely by Apple through StoreKit:
WalkUpFire Yearly — an auto-renewing annual subscription that unlocks full access to the App. Payment is charged to your Apple ID at confirmation of purchase. The subscription automatically renews for the same length and price at the end of each period unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel auto-renewal at any time in Settings → Apple ID → Subscriptions on your device. Cancellation takes effect at the end of the current paid period; no partial-period refunds are issued by us.
WalkUpFire Lifetime — a one-time, non-consumable in-app purchase that unlocks full access to the App for as long as the App is available on the App Store and runs on your device. The lifetime tier is not a subscription and does not renew.
Lifetime Founder grant — users who installed the App during its free
launch period receive a silent lifetime entitlement determined by Apple’s
originalApplicationVersion receipt field. No purchase is required. This
grant is tied to your Apple ID.
To restore a previous purchase on a new device, open Settings inside the App and tap Restore Purchases.
Subscription and purchase terms are also subject to Apple’s Media Services Terms. Refunds, where available, are handled by Apple under Apple’s refund policy.
Apple Music
WalkUpFire integrates with Apple Music through MusicKit but does not include or resell an Apple Music subscription. To assign and play Apple Music catalog tracks, you need your own active Apple Music subscription from Apple. We are not responsible for Apple Music availability, catalog changes, or tracks that become unplayable in your region.
No warranty
The App is provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or compatible with every device, iOS version, Bluetooth speaker, or field condition. You are responsible for verifying your audio setup before a game, including running the App’s pre-game offline audit.
Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the App — including but not limited to damages for loss of data, missed or mistimed audio during a game, speaker or equipment malfunction, or third-party service outages (including Apple Music or iCloud). Our total liability for any claim relating to the App is capped at the amount you have paid us for the App in the twelve months preceding the claim.
Privacy
Your use of the App is also governed by our privacy policy, which explains what data the App does and does not collect. In short: we have no servers and we do not collect personal information from you. Your roster and song metadata sync through your own iCloud container; audio files stay on your device.
Changes
We may update these terms from time to time. The updated version will be published at this URL with a new “Last updated” date. Your continued use of the App after a change constitutes acceptance of the updated terms.
Governing law
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Any dispute arising out of these terms will be resolved in the state or federal courts located in San Mateo County, California.
